How can I change the legal owner of my .au domain?
This can be done, however only under certain circumstances. Please refer to auDA policy. The simple form of that stated in the above link is as follows: - If we're not the registrar of record of your domain, you will first need to transfer to us (see 'How do I transfer a domain to name.com.au?')
- If we are the registrar of record, please complete the Change of Registrant kit. (If this link does not work in your browser you can navigate directly to name.com.au/pdf-library/). This kit includes the following:
- Written notification from an authorised representative for the current registrant, that clearly states who the domain should be transferred to, and the reason for transfer.
- Written notification from the gaining registrant stating that they accept the domain name for the above mentioned reason, and that they are happy to enter into a service agreement with name.com.au, and that all terms and conditions are agreed to. Our service agreement may be viewed at name.com.au/policies/.
Circumstances for transfer A registrant may transfer their domain name licence to a proposed new registrant if: - the domain name is used within the operations of the registrant and either the registrant or the operations are acquired by, merged into, devolved to or joined with the operations of the proposed new registrant; or
- the registrant, being a legal entity, is dissolved, liquidated, enters into administration or is wound up with the consequence of the registrant's licence passing to the proposed new registrant by operation of law;
- the registrant, being a natural person, dies, becomes insane or enters into a deed of family settlement with consequence of the registrant's licence passing to the proposed new registrant by operation of law; or
- the registrant is required to relinquish the licence to the proposed new registrant by order of a competent arbitrator, tribunal, court or legislative body; or
- the registrant has entered into an agreement to transfer the licence to the proposed new registrant in settlement of a dispute between the parties, as evidenced by a deed of settlement;
